Terms and Conditions
Introduction
These Terms & Conditions (“Terms”) govern your access to and use of the Gravity Booking plugin and related services (the “Service”) offered via gravitybooking.com (and associated sites). By purchasing, installing, activating, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use or install the Service.
Definitions
- “We,” “us,” or “Gravity Booking” refers to the company or entity providing the plugin, support, and services.
- “You,” “user,” or “customer” means the person or legal entity who purchases, installs, uses, or otherwise interacts with the Service.
- “Plugin” / “Product” refers to the software component (Gravity Booking add-on for Gravity Forms) and any modules, extensions, updates, patches, or enhancements we provide.
- “License” means the rights granted to you under Section 4.
- “Support” means technical assistance, documentation, bug fixes, updates, as per the support policy.
Grant of License & Use Rights
- Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to use the Plugin on the site(s) permitted under your chosen plan (single, multi-site, etc.).
- You may not distribute, sublicense, rent, lease, sell, or transfer the Plugin (modified or unmodified) to any third party, unless expressly allowed by us in writing.
- The license covers access to updates and support for the duration specified in your plan or subscription.
- If you do not activate or validate your license, the Plugin may function in limited mode (e.g., no updates) or cease to work entirely, per our licensing policies.
Fees, Payment, & Renewals
- You agree to pay the fees set out on our pricing page, in the currency and via the payment methods we accept.
- Subscriptions renew automatically (if applicable), unless you disable auto-renewal prior to the renewal date.
- We reserve the right to change pricing, add or remove features, or adjust plans. We will notify you in advance of material changes.
- If a payment fails (e.g., expired card), we may suspend or disable your access to updates or support until the payment is resolved.
Refund & Cancellation Policy
- Refunds may be requested within 14 days of purchase, subject to the conditions below.
- To request a refund, you must submit a support ticket, allow us to troubleshoot, and agree to deactivate and uninstall the Plugin from all sites.
- Refunds will not be granted after the 14-day window.
- We may refuse a refund request if the Plugin functions as described or if the issue is due to third-party software, server environment, or improper configuration.
- Upon cancellation, your license will expire at the end of the period, and you will lose access to support and updates.
Delivery, Updates & Support
- The Plugin and all its components (code, design, logos, documentation) are our intellectual property (or licensed to us).
- You retain ownership of content you create using the Plugin (e.g., bookings, form entries), but not the Plugin itself.
- You may not remove, alter, or obscure copyright notices or credits in the Plugin.
User Obligations & Restrictions
You must not:
- Use the Plugin in any unlawful manner or for illegal purposes.
- Reverse engineer, decompile, or disassemble the Plugin (to the extent prohibited by law).
- Remove watermark, license verification, copy protection, or anti-tamper measures.
- Use the Plugin in a way that subjects our systems (if applicable) to undue load or security risk.
- Attempt to circumvent license validation, share license keys, or use one license on more sites than permitted.
Warranty Disclaimer & Limitations of Liability
- The Plugin is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and noninfringement.
- We do not guarantee uninterrupted or error-free operation.
- To the maximum extent permitted by law, our liability (and that of our affiliates, employees, etc.) is limited to the amounts you have paid for the Plugin.
- Use the Plugin in a way that subjects our systems (if applicable) to undue load or security risk.
- This limitation applies regardless of the cause or legal theory, even if we have been advised of possible damages.
Indemnification
You agree to indemnify, defend, and hold harmless Gravity Booking, its officers, employees, and affiliates from any claims, liabilities, losses, damages (including attorneys’ fees) arising out of:
- Your use (or misuse) of the Plugin;
- Your violation of these Terms;
- Your breach of any representations, warranties, or third-party rights.
Termination
- We may terminate or suspend your license and access instantly if you breach these Terms.
- Upon termination, all rights granted to you under this agreement cease immediately.
- You must cease use of the Plugin, uninstall, and delete all copies.
- Termination does not relieve you of liability for obligations (e.g., payment, indemnification) accrued prior to termination.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will post updated Terms on the site with a “Last Updated” date. Your continued use after changes constitutes acceptance. It is your responsibility to review these Terms periodically.
Governing Law & Disputes
These Terms shall be governed by global laws wherever applicable.
Severability & Waiver
If any provision is held invalid or unenforceable, that part will be struck, but the remaining provisions will remain in force. Our failure to enforce a right or provision does not constitute a waiver of that right.
Entire Agreement
These Terms, together with any policies or documentation we publish (support policy, refund policy, license terms, privacy policy), form the entire agreement between you and us with respect to the Plugin, superseding all prior agreements or understandings.
Multiple Sites License Usage
Our multiple sites licensing plans are designed to support agencies, developers, and service providers who manage several client websites under their own brand.
These licenses allow the use of our plugins on the specified number of client sites associated with the purchased plan.
Please note that these plans do not grant permission to white-label, resell, or repackage our plugins as a standalone product under another name or entity.
By purchasing and using a multiple sites license, you agree to respect these limitations and acknowledge that any use outside of the intended purpose—such as white-labeling, reselling, or redistribution—is strictly prohibited.
Lifetime License Policy
Here, “Lifetime” refers to the lifetime of the product, not the buyer’s lifetime or any other interpretation.
The product lifetime is defined as the period starting from when a product is first made available for sale until the point it is officially discontinued.
We reserve the full right to announce the end of a product’s lifetime at any time, with prior notice of 45–90 days.
